1. Description of Service

1Klick Ads is a SaaS (Software as a Service) platform that allows users and businesses to:

• Define brand identity through guided forms and voice transcription
• Generate AI-assisted advertising campaign strategies
• Create ad copies using AI models (OpenAI)
• Generate ad images using AI models (Google Gemini)
• Connect their Meta Business account (Facebook / Instagram Ads) via OAuth
• Publish advertising campaigns directly to Meta Ads Manager

2. Eligibility and Registration

2.1 Requirements

To use the Platform you must:

• Be at least 18 years of age
• Have legal capacity to enter into contracts in your jurisdiction
• Provide accurate and up-to-date information during registration
• Be the owner or have authorization to manage the Meta advertising accounts you connect

2.2 Account security

You are responsible for maintaining the confidentiality of your password and all activities that occur in your account. Notify us immediately at digitalcompass.ia@gmail.com if you suspect unauthorized access.

3. Subscriptions and Payments

3.1 Payment plans

1Klick Ads operates under a subscription model. Prices, features and limits for each plan are available at 1klickads.com/#pricing. We reserve the right to modify plans with 30 days prior notice.

3.2 Billing

Payments are processed through Stripe. The subscription renews automatically at the beginning of each billing period (monthly or annual, depending on the chosen plan). You are responsible for maintaining a valid payment method.

3.3 Refunds

We offer a full refund within the first 7 days after initial contracting if you are not satisfied with the Service. After that period, payments are non-refundable, except for verifiable billing errors or applicable legal provisions.

3.4 Taxes

Displayed prices do not include applicable taxes (VAT or others). Corresponding taxes will be added based on your location at the time of billing.

4. Acceptable Use

4.1 Permitted uses

You may use the Platform only to create and manage legitimate advertising campaigns on Meta, in accordance with Meta Platforms, Inc.'s advertising policies.

4.2 Prohibited uses

It is strictly prohibited to:

• Use the Platform to create misleading, fraudulent, discriminatory ads or ads that violate Meta's Advertising Policies
• Advertise illegal products or services in any applicable jurisdiction
• Attempt unauthorized access to systems, accounts or data of other users
• Reverse engineer, decompile or copy the Platform's code or algorithms
• Resell or sublicense access to the Service without written authorization
• Use bots, scrapers or other unauthorized automated means to interact with the Platform
• Interfere with the availability or integrity of the Service

Violation of these restrictions may result in immediate suspension or cancellation of your account.

5. AI-Generated Content

5.1 Nature of content

The Platform uses third-party Artificial Intelligence models (OpenAI for text, Google Gemini for images) to generate advertising content. This content is automatically generated and may contain inaccuracies, imprecisions or unwanted elements.

5.2 User Responsibility

Before publishing, you must verify that the content:

• Is truthful and not misleading
• Complies with Meta's Advertising Policies
• Does not infringe third-party intellectual property rights
• Complies with applicable legislation in the territories where it will be published

5.3 Ownership of generated content

AI-generated content based on your brand information belongs to you. We grant you a non-exclusive license over the generated outputs to use them in your advertising campaigns.

6. Meta Integration (Facebook / Instagram)

6.1 Authorization

By connecting your Meta account, you authorize us to act on your behalf to create campaigns, ad sets and ads in your advertising account using the Meta API.

6.2 Meta policy compliance

You are responsible for ensuring that all published campaigns comply with Meta's Advertising Policies and Facebook Community Standards. 1Klick Ads is not responsible for rejections, suspensions or penalties that Meta applies to your ads or account.

6.3 Access revocation

You can disconnect your Meta account at any time from the Platform's Settings section. When you do, we will delete your access token from our servers. You can also revoke access directly from your Facebook account settings.

7. Intellectual Property

7.1 Platform

All code, design, interfaces, flows, documentation and other elements of the Platform are the exclusive property of 1Klick Ads and are protected by applicable intellectual property laws. No license is granted to you over them beyond using the Service under these Terms.

7.2 Your content

You retain all rights to brand information, texts, logos and other content you upload to the Platform. You grant us a limited, non-exclusive license to process and use that content solely for the purpose of providing you with the Service.

8. Service Availability and Changes

8.1 Availability

We strive to keep the Service available 24/7, but we do not guarantee uninterrupted availability. We may perform scheduled maintenance with prior notice when possible.

8.2 Modifications

We reserve the right to modify, suspend or discontinue any feature of the Platform at any time. For material changes, we will give at least 30 days advance notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• 1Klick Ads shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of revenue, profits or data.
• Our total liability to you for any claim related to the Service shall not exceed the amount paid by you in the 3 months prior to the event giving rise to the claim.
• We are not responsible for Meta rejections or penalties on your campaigns, your ad performance, or changes in Meta's APIs or policies that affect the Service's operation.
• We do not guarantee specific advertising results (clicks, conversions, sales).

10. Indemnification

You agree to indemnify and hold harmless 1Klick Ads, its officers, employees and collaborators, from any claim, damage, loss or expense (including reasonable legal fees) arising from: (a) your use of the Service; (b) the content of your advertising campaigns; (c) your breach of these Terms; or (d) your violation of third-party rights.

11. Termination

11.1 By the User

You may cancel your subscription at any time from your account settings. Access will be maintained until the end of the current billing period.

11.2 By 1Klick Ads

We reserve the right to immediately suspend or terminate your account if: (a) you violate these Terms; (b) your use poses a legal or security risk; (c) you fail to make the corresponding payment.

11.3 Effect of termination

Upon account termination, we will delete your data in accordance with our Privacy Policy. The provisions of these Terms that by their nature should survive termination will do so (including limitation of liability and indemnification).

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States. For any dispute arising from these Terms or the use of the Service, the parties submit to the jurisdiction of the competent courts of Mexico City, expressly waiving any other jurisdiction that might apply.

13. Changes to these Terms

We may update these Terms periodically. We will notify you by email and/or through a notice on the Platform with at least 15 days advance notice when changes are material. Continued use of the Service after the new Terms take effect implies your acceptance.

14. General Provisions

• Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and 1Klick Ads regarding the Service.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
• No waiver: Our failure to exercise any right under these Terms does not constitute a waiver of that right.
• Language: In case of discrepancy between versions in different languages, the Spanish version shall prevail.
